Defense Verdict Sustained on Appeal

A defense verdict won by Mike Regan and Steve O’Hara was upheld on appeal in a decision by the Florida First District Court of Appeal on March 19, 2013. The appeals court rejected the plaintiffs’ arguments (1) that a biomechanical expert cannot testify that there was no mechanism of injury in the accident and (2) that the verdict was inadequate rather than inconsistent (to preserve a right to appeal an inconsistent verdict, an objection must be made before the jury is discharged, and that was not done). Susan wrote our Answer Brief in the appellate court, and Mike Regan made our oral argument to the court.
