Steve O’Hara Wins Again


After a six-day jury trial, Steve O’Hara won a favorable verdict for their client, the defendant, in Clay County, Florida, on April 22, 2013. The case involved a motor vehicle collision. The issues were fault, causation, permanency, and damages. The plaintiffs asked for over $3.5 million in damages after the middle-aged female plaintiff underwent shoulder surgery and extensive pain management procedures for alleged neck and back pain. The jury found the defendant to be 57% at fault, found that the plaintiff did not sustain a permanent injury, and awarded damages of $116,655.57 for past medical expenses and lost earnings. Those damages will be reduced to $66,493.67 (57% 0f the damages awarded), which is more than 25% less than the defendant’s formal pretrial proposal for settlement. The plaintiffs have filed a motion for a new trial.
