J.D. Morgan with the assistance of Peter Kellogg recently had a jury return a verdict of no liability as to our client in St. Johns, County after a four-day jury trial. The Plaintiff sued our client alleging negligent maintenance of some outside stairs causing a step to come loose and the Plaintiff to fall.
Plaintiff had its experts claim the stairs were defectively constructed while the local contractors who had recently updated the stairs defended their work as routine maintenance. There had been no issues with the stairs other than the Plaintiff’s alleged fall. Over objection from Plaintiff, the jury was shown a security video showing tnhe Plaintiff calmly walking down the stairs without incident within a minute or so of when the alleged fall occurred. The jury deliberated for slightly more than an hour before rendering its verdict finding no negligence.
